dischargeRx Terms of Service
Draft for legal review, not legal advice. Adapted to what dischargeRx actually is (a care organizer with document scanning/AI extraction, a permission-based care circle, local-first + Supabase sync). Complete every
[BRACKETED]value and have qualified counsel review before publishing. The medical disclaimer (§5), arbitration / class-action waiver (§12), and liability limits (§9) are consequential and their enforceability varies by jurisdiction, so they must be localized for each market you launch in.
Effective date: 07/26/2026 Last updated: 07/26/2026
Please Read Carefully
These Terms of Service are a legally binding agreement between you and Haney Group, LLC. By creating an account or using dischargeRx, you agree to be bound by them. If you do not agree, do not use the app. Key terms include an important medical disclaimer, limitations on our liability, and a dispute-resolution clause.
1. Acceptance and Eligibility
These Terms govern your access to the dischargeRx mobile application, website, and related services (the "Service"), provided by Haney Group, LLC ("dischargeRx", "we", "us", "our"), registered in the State of Texas. By using the Service you confirm that:
- You have read these Terms and our Privacy Policy, which is incorporated by reference.
- You are at least 18, or 13–17 with verifiable parental/guardian consent.
- You have legal capacity to enter this agreement.
- You are not barred from using the Service under applicable law.
If you set up a profile for a minor or another person, you confirm you have the authority to do so and accept these Terms on their behalf.
2. What the Service Is
dischargeRx is a care organizer and reminder app. It helps you turn the instructions your care team gives you into an organized schedule of reminders. The Service lets you:
- Build and manage care plans: medications you enter or confirm, doses, schedules, tasks, appointments, alarms, and completion history.
- Scan or upload care documents (discharge papers, prescriptions, visit summaries, labels) and have them read into a draft plan you review.
- Receive on-device reminders for doses, tasks, and refills.
- Invite helpers/caregivers to a care circle with the permissions you grant.
- Use Premium features (below).
The Service is not a medical device, a medical-records system, a clinical decision-support tool, a pharmacy, a medication database, or a telehealth platform. See §5.
3. Accounts and Security
3.1 Creating an account. dischargeRx is usable offline without an account; to sync and use the care circle, create an account with a valid email and password (managed by Supabase Auth). We may offer additional sign-in methods over time. Provide accurate information.
3.2 Security. You are responsible for keeping your credentials confidential, using a strong unique password, signing out of shared devices, and notifying us at security@dischargerx.app if you suspect unauthorized access. We will never ask for your password by email or in-app message.
3.3 Responsibility. You are responsible for activity under your account. Do not share credentials; the care circle is the correct way to give another person access to care data.
4. Care Circle, Helpers, and Permissions
4.1 Invitations. Only the person who owns a care plan can invite a helper; helpers cannot add themselves. Invitations use a code/link you share and can be revoked at any time; redemption attempts are rate-limited for security.
4.2 Permission-based access. Rather than a single "edit" switch, you grant specific permissions, for example viewing the plan, receiving missed-step alerts, adding care notes, completing tasks, or viewing documents. Helpers cannot change your account credentials, subscription, or another household's data. You can change a helper's permissions or remove them at any time; removal takes effect immediately.
4.3 Helper responsibilities. If you use dischargeRx as a helper, use your access only to support the person who invited you, keep their care information confidential, act accurately, and do not attempt to access any household you were not invited to.
5. Medical Disclaimer
dischargeRx is an organizer and reminder tool. It is NOT a medical device, NOT clinical decision support, and NOT a substitute for professional medical advice. Nothing in the app is medical advice, diagnosis, or treatment. Always follow your care team and consult a qualified professional about your medications and care.
The Service does not:
- Verify the accuracy, completeness, or appropriateness of information you enter or that is extracted from a document.
- Detect or warn about drug interactions, contraindications, overdose risks, or other medication-safety concerns.
- Tell you whether to take, skip, adjust, or stop any medication or care step.
- Replace a physician, pharmacist, nurse, or other licensed professional.
- Guarantee that reminders or helper alerts are delivered on time, or at all.
You acknowledge that:
- Any decision to take, skip, delay, or change a dose or care step must be made with your healthcare provider.
- Extracted plans and templates are starting points you must review and confirm against your care team's actual orders; nothing auto-activates.
- Progress and adherence figures reflect only what has been logged and may not match reality.
- In an emergency, call your local emergency services. Do not rely on dischargeRx reminders or helper alerts.
6. Subscriptions, Payments, and Refunds
6.1 Free and Premium. dischargeRx offers a Free tier (an active care plan, reminders, and completion tracking) and a Premium tier (document scanning/extraction, care-circle sync, missed-step alerts, multiple plans, refill tracking, progress reports, and additional caregiver controls).
6.2 Pricing. Premium is $4.99/month or $49.99/year (or local equivalent), as shown at purchase. dischargeRx does not currently offer a free trial.
6.3 Billing. When paid subscriptions are enabled, purchases are processed by the Apple App Store or Google Play, and subscriptions auto-renew unless cancelled at least 24 hours before the period ends. (If billing is not yet active in your region/build, no charge is made and Premium may be offered in preview; this section governs once billing is live.)
6.4 Cancellation. Cancel anytime in your App Store / Google Play subscription settings. Cancellation stops renewal; you keep Premium until the period ends. Cancelling a subscription is separate from deleting your account.
6.5 Refunds. Refunds are handled by Apple or Google under their policies. For a billing problem caused by us, contact support@dischargerx.app.
6.6 Price changes. We will give at least 30 days' notice of price changes to existing subscribers; changes take effect at the next renewal.
7. Acceptable Use
You agree not to:
- Track or organize care for a person who has not consented.
- Share another person's care data (e.g. via a helper invite) without their knowledge.
- Access another user's account or household without authorization.
- Use bots/scripts to interact with or extract data from the Service.
- Reverse-engineer, decompile, or disassemble the app.
- Overburden, damage, or interfere with the Service or its security features.
- Upload unlawful, harmful, or infringing content, or impersonate anyone.
- Resell or commercialize access without our written permission.
- Rely on dischargeRx as an emergency-response system or a substitute for professional care.
Violations may result in suspension or termination.
8. Intellectual Property
8.1 Our property. dischargeRx's code, designs, graphics, the dischargeRx name, logo, and brand marks are owned by Haney Group, LLC and protected by law.
8.2 License to you. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on devices you control for personal, non-commercial use.
8.3 Your content. You retain ownership of the care data, notes, documents, and other content you enter ("Your Content"). You grant us a limited license to store, process, and transmit Your Content solely to provide the Service, including sending documents you submit to our AI extraction provider to produce a draft plan for your review.
8.4 Feedback. If you send suggestions, you grant us a perpetual, royalty-free license to use them without obligation.
9. Disclaimers and Limitation of Liability
9.1 As-is. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that reminders, imports, sync, or helper alerts will always work or be timely.
9.2 Limitation. To the maximum extent permitted by law, dischargeRx and its operators are not liable for indirect, incidental, special, consequential, or punitive damages; lost data or profits; or physical harm, adverse events, or health outcomes arising from missed reminders or reliance on the Service. Our total cumulative liability will not exceed the greater of (a) what you paid us in the 12 months before the claim, or (b) USD 100.
9.3 Exceptions. Some jurisdictions do not allow certain exclusions; there, our liability is limited to the greatest extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Haney Group, LLC and its personnel from claims arising out of your use of the Service, your violation of these Terms or the law, Your Content, or any action by a helper you invited under permissions you granted.
11. Term, Suspension, and Termination
These Terms apply from your first use until terminated. You may terminate by deleting your account (Settings); synced data is deleted per the Data Deletion Process; cancel any subscription separately through the store. We may suspend or terminate for material breach, legal requirement, discontinuation of the Service, or suspected compromise. §§5, 8, 9, 10, and 12 survive termination.
12. Governing Law and Dispute Resolution
(Localize this entire section per market before launch.)
12.1 These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
12.2 Informal first. Before any formal proceeding, contact legal@dischargerx.app; we will try to resolve the dispute within 60 days.
12.3 Arbitration / class waiver. Where enforceable, disputes are resolved by binding individual arbitration, and you waive class actions and jury trial. [This clause must be reviewed for enforceability and consumer-law limits in each jurisdiction; some regions require it be removed or modified.]
12.4 Otherwise, the courts of the State of Texas have exclusive jurisdiction.
12.5 Any claim must be brought within one (1) year of arising, where such limits are permitted.
13. Changes
We may modify the Service or these Terms with at least 30 days' notice of material changes, via in-app notice and email. Continued use after the effective date is acceptance; otherwise, stop using the Service and delete your account.
14. General
Entire agreement with the Privacy Policy. Severability: invalid terms are narrowed, the rest survive. Waiver: non-enforcement is not a waiver. Assignment: you may not assign without our consent; we may assign in a merger/sale. Force majeure: no liability for events beyond reasonable control. Notices to us: legal@dischargerx.app; to you: your account email or in-app. Language: English controls. No third-party beneficiaries.
